Terms of Service
These terms apply when you ("Client") order 3D scan post-processing services from 3D Scan Guild, operated by Individual Entrepreneur Vitalii Volodymyrovych Kyrylko (FOP), registered in Ukraine ("we", "us"). By sending us files, placing an order or paying an invoice, you agree to these terms. If you have a separate signed agreement with us, that agreement takes priority.
01Services
We reconstruct, clean, sculpt, texture and prepare 3D scans for printing, based on the files and instructions you provide. The exact scope of each order is what you request and we confirm. We decide how to perform the work and which tools and team members to use.
02Your files and instructions
- You provide the source files (photo sets or meshes) and your requirements: printer, file format, size, base and style preferences.
- The quality of the result depends on the quality of the source files. We are not responsible for defects that come from poor source data, missing areas or incorrect instructions.
- If a scan is too damaged for standard cleanup, we tell you before we start and offer options, for example AI-assisted reconstruction from several photos finished with hand sculpting, or classic scan cleanup with the missing parts modeled by hand. The approach and price for such scans are agreed with you individually before any work begins.
03Your permissions
You confirm that you own the files you send us or have every permission needed to have them processed by a contractor, including the consent of the people scanned (and of a parent or guardian for anyone under 18). You will not send content that is illegal or infringes anyone's rights. You agree to cover any claims, losses and costs we face because this is not true.
04Turnaround
Our usual turnaround is 48–72 hours from receiving complete files. Turnaround times are estimates, not guarantees. They may be longer for complex scans, large orders, incomplete files, holidays or events outside our control. Rush delivery is available only when we confirm it.
05Revisions and acceptance
- Each model includes two rounds of revisions, requested within 7 days of delivery. Revisions requested after that period are charged separately.
- Revisions cover corrections to the original request. Changes to the pose, design, size or requirements after work has started are new work and are charged separately.
- If you do not request revisions within that period, or once you print or use the files, the order is considered accepted.
06Prices and payment
- Prices are those shown on our website or agreed with you in writing for your account. We may change prices with 30 days' notice. Orders already in progress keep the old price.
- Invoices are payable within 7 days of delivery. For regular clients we can agree on flexible payment terms. For very large orders we may ask for partial prepayment.
- If payment is late, we may pause work on all your orders and withhold files until the balance is paid.
- Fees for delivered work are non-refundable.
- Payment is made by one of the methods listed on our Payment Methods page.
07Ownership
Once an order is paid in full, you own the delivered files and may use them for your business. Until then, the files remain ours. We keep all rights to our own tools, methods, templates and know-how. We will not show your scans publicly without your permission.
08Confidentiality
We treat your files and business information as confidential and use them only to provide our services, as described in our Privacy Policy. You also keep our prices, terms and working methods confidential. We sign a separate NDA on request.
09Our team
During our work together and for 12 months after it ends, you agree not to hire or engage, directly or through others, any of our artists or staff you have worked with, without our written consent.
10Printing
We prepare files for printing according to your instructions. Print results also depend on your printer, materials, settings and handling, which we do not control. Check every file before printing. We are not responsible for failed prints, material costs, machine time or damaged figurines.
11File storage
We are not a file storage service. We may delete source and finished files after the order is complete. Keep your own copies of everything you send and receive.
12Liability
- Our services are provided "as is". We do not give warranties beyond what these terms say.
- We are not liable for lost profits, lost orders, lost data, reputational damage or any indirect or consequential losses.
- Our total liability for any claim is limited to the amount you paid us for the specific order the claim relates to.
13Ending our work together
Either side may stop working together at any time by written notice. You pay for all work completed or in progress up to that point. Sections on payment, ownership, confidentiality, our team and liability continue to apply after we stop working together.
14Governing law and disputes
These terms are governed by the laws of Ukraine. We will first try to resolve any dispute through good-faith discussion. If that fails, disputes will be decided by the courts of Vinnytsia, Ukraine.
15Changes
We may update these terms from time to time. The current version is always on this page. Orders placed after an update follow the new terms.
